Usage data is data that you do not actively provide us but instead may be passively collected while you navigate a website, for example. When you are visiting our online service, we save the domain name or IP address of the computer requesting access, the client data request (data name and URL), the http answer code, the Internet site you are visiting from and the date and duration of your visit for a period of four (4) business days. We store your data in order to investigate disruptions to or abuse of our online service and our telecommunications services/equipment to the extent required to create further connections and/or generate invoices. We will not analyse your usage data to create a personal user profile for you unless you have expressly agreed to this. In the event of disruption or abuse, we reserve the right to inform the law enforcement authorities. We will not utilise your usage data for any other purpose or forward it to third parties.

3. The utilisation of cookies

• What are cookies?

A cookie is a small text file that the relevant server transmits during a visit to a website. It is cached on the respective user’s hard drive. If the relevant server is contacted again, the user’s browser transmits the cookie it has received back to the server. The server has a number of options for analysing the information it receives in this way.

• How do we use cookies?

When users visit one of our web pages, cookies are transmitted to their browsers and saved on the hard drive of their computer. Cookies make our online service more user friendly, more effective and more secure. As cookies do not contain any personal data or personal information about you, we are not able to identify you based on the information in the cookies. The information a cookie contains is only used for the purpose of creating statistics on how people use our online service. The statistics allow us to adapt our online service to your requirements as optimally as possible and make it as convenient as possible for you to surf our online services.

• How do third parties set cookies and Web beacons on our online services?

As part of our online services, we use Google Analytics, a Web analysis service from Google, Inc., U.S.A. (‘Google’). Google Analytics uses cookies that enable the way you use our online services to be analysed. The information the cookies generate on your usage of our online service (including your IP address) is transmitted to one of Google’s servers in Europe or a member state of the European Economic Area Agreement to render the IP address anonymous and eliminate any way of using it to identify your person. This abbreviated IP address is not transmitted to a server in the U.S.A. until the IP address has been anonymised. In exceptional cases only, the full IP address may be transmitted to a Google server in the U.S.A. and shortened there. On our behalf, Google will use the information the cookies generate to analyse the way you use our online service, to compile reports on the utilisation of the online services and to perform the services in conjunction with the utilisation of the online services and internet utilisation in general.
The (shortened) IP address will not be combined with other data from Google. In addition to the browser preferences listed in section 3: ‘Utilisation of cookies – How can cookies be removed?’, you can prevent Google from processing your data by downloading and installing the browser plug-in available at the following link:
www.tools.google.com/dlpage/gaoptout?hl=de
Our online service uses Google AdSense, a Google Inc., USA (‘Google’) Web service, via the context-dependent advertisements (ads) of third-party vendors based on the search terms in search engines or keywords in the website content that are contained within our online services. For this reason, we would like to point out that Google drops and reads out cookies on your browser as part of these ads and may also use Web beacons (small, invisible graphic files) to collect information. The information generated by the cookies and/or Web beacons is forwarded to a Google server in the U.S.A. and processed there. The use of DoubleClick DART cookies allows Google to use the information from your visits to our online services and other websites to target specific ads using the frequency-capping process. This guarantees that you are exposed to the ads with a fixed frequency based on standardised criteria. You can opt out of receiving DoubleClick DART cookies by visiting the Google advertising opt-out page. Go to the Google Policies page and click on ‘Advertising’ in the ‘Privacy’ category and follow the instructions there for controlling advertising cookies.

In this online service, we use the Scalable Centralised Measurement System (SZM) from INFOnline (https://www.infonline.de) to determine the statistical parameters related to using our online service. It gathers anonymous values in the process. The SZM reach measurement process uses either a cookie with the code ’ivwbox.de’ or a signature created from various information automatically transmitted by your computer to recognise computer systems. The process does not require IP addresses to be saved and they are processed in anonymised form only. The process for measuring reach was developed with data privacy in mind. The aim of this process is to statistically define the intensity of use and number of users for any given website. Individual users remain anonymous at all times. Your identity is always protected. This system is not used to send you advertising. For Web services that are members of the German Audit Bureau of Circulation (IVWwww.ivw.eu) or are participating in the German Working Group for Online Media Research (AGOFwww.agof.de) ‘Internet facts’ study, the usage statistics are published on a monthly basis by AGOF, the German Working Group for Media Analysis (ag.ma – “www.agma-mmc.de”
:http://www.agma-mmc.de), and the IVW and can be viewed at http://www.agof.de, http://www.agma-mmc.de and http://www.ivw.eu. In addition to publishing measured data, the IVW verifies the SZM process regularly to ensure it is being used in compliance with the law and to protect data privacy. For additional information on the SZM process, visit the INFOnline GmbH website (https://www.infonline.de) (the association that implements the SZM process), the AGOF data privacy policy website (www.agof.de/datenschutz) or the IVW data privacy policy website (http://www.ivw.eu). To opt out of SZM data processing, use the following link: www.optout.ivwbox.de.

• How can I remove the cookies?

If you do not want to benefit from our cookies or those set by third-party vendors, you can use our online services without cookies. Every browser can be set to reject cookies in general. You can also delete cookies that have been set at any time. If you want to deny cookies, please follow these notes on ‘Denying cookies’. If you do not accept any cookies, this may lead to the functional impairment of the website in isolated cases. Please note that when you delete the existing cookies in your browser, you are also deleting the settings relevant to the way we or third-party vendors process your information. If you delete the cookies that are saved in your browser, remember to reset your preferences so that your information can be processed by us or third-party vendors.

4. Usage-based online advertising

The advertising in this online service is optimised to serve you based on your projected interests by means of the anonymous gathering and processing of your usage behaviour. As a content provider and subsidiary of the ProSiebenSat.1 Group and the companies connected to ProSiebenSat.1 Digital GmbH as per §§ 15 et al. of the German Stock Corporation Act (AktG), ProSiebenSat.1 Digital GmbH (the operator of this online service) is the party responsible. To accomplish this, on our behalf third party companies set cookies (learn more in section 3: ‘Utilisation of cookies – What are cookies?’) on your computer to record your usage data. Usage data is the data that may be passively collected while you navigate the pages of this website, for example. Any IP addresses that are recorded are anonymised to eliminate any way of identifying you personally.

Our company voluntarily submits to self-regulation as outlined by the German Privacy Policy Council for Online Advertising (DDOW). You can learn more about the self-regulation code that applies to us (Kodex für Telemedienanbieter – Erstparteien/Code for Content Providers – First Parties) at the following link: www.meine-cookies.org/ddow.html.

5. Forwarding your data

We will not forward your data to our partners or other third parties unless

• this is necessary in order to make the services available, process them or invoice you, in which case we will send your data to our agents for the respective purpose;

• you have provided us with your express approval, or

• we are obligated to submit this data, due to an order from the court or other authorities.

6. Changing your data

We make an effort to store your personal data correctly. You can change your data in the Profile area of the respective service (i.e. update, correct and/or supplement it) or delete it at any time. To protect your privacy and your security, we will verify your identity before you can change your data. If you are unable to change the data in your profile area or you do not have a profile area, please contact us at the following email address: Licensing@ProSiebenSat1.com

7. Revocation option

If you are no longer interested in receiving certain information or offers in future or you do not want to receive the information/offers via a certain channel, please inform us of this by sending an email to us at Licensing@ProSiebenSat1.com. We will immediately take the required action. You can also contact the address above if you would like to revoke your permission to collect, process and utilise your data for the future. In this case, we will immediately delete all of your data that we have stored. Please take into consideration that due to technical or organisational reasons, an overlap between your revocation and the utilisation of your data as part of an ongoing campaign may occur.

8. Information on the use of social plug-ins

8.1. Facebook

We use the social plug-in of the www.facebook.com social network (‘plug-in’) operated by Facebook Inc., 1601 S.California Ave, Palo Alto, CA 94304, U.S.A. (Facebook) on some of our websites. The websites in our online service that contain a plug-in are labelled with a clearly visible Facebook logo (e.g. a white f on a blue square or a thumbs-up icon) or the tag ‘Facebook social plug-in’.

When you open a website that contains this type of plug-in, your browser creates a direct connection to the Facebook servers and Facebook transmits the content of the plug-in directly to your browser.
If you are a registered Facebook user and are logged into your Facebook user account, the plug-in tells Facebook that you have opened the website in question. If you actively use the plug-in by clicking on the ‘Like’ or ‘Share’ button or entering a comment on the website in question, your browser will transmit the relevant information directly to Facebook, which will use it. To prevent Facebook from collecting the aforementioned information about you when you open a website, see the Facebook website for more information and/or log out of Facebook before opening the website. In addition, you should probably delete any cookies from Facebook from your browser. You will find information on the purpose and extent of the data collection and its further application and utilisation by Facebook, as well as your rights in this regard and preferences you can set for protecting your privacy in Facebook’s notes in the Facebook data privacy policy. Please note: Facebook frequently introduces changes to its set-up so you will have to stay up to date on the corresponding changes in data usage. You can find more information on the options for protecting your privacy that Facebook provides on the following pages: http://de.facebook.com/privacy/explanation.php. We do not assume any liability for the content of the websites and Facebook’s notes on its data privacy policy.

9. Liability disclaimer for partners’ websites

On our pages, we have links to various partners that have their own websites and online services. As a rule, they have their own data privacy policies. We do not assume any liability for these policies, which have nothing to do with us. Please visit them for information about their respective data privacy policies.

10. Data security

We feel it is our duty to maintain your data security. To prevent unauthorised access or unauthorised disclosure, to guarantee the correctness of the data and to safeguard the authorised utilisation of the data, we have set up relevant technical and organisational processes to safeguard and protect the data that we gather online. However, we cannot assume any responsibility or liability for the disclosure of your data caused by errors in data transfer and/or unauthorised third-party access.

11. Information/suggestions

We would be happy to receive information and suggestions on data protection and privacy – please contact us at the following email address: Licensing@ProSiebenSat1.com

We reserve the right to change this general data privacy policy at any time, taking the valid privacy protection laws into consideration. In regard to the utilisation of our online services, the version of the general data privacy policy that is valid at the time of your online visit is applicable.
